The established record
The records show an order of events. First a guilty plea. Then a broad presidential pardon. Then Flynn took part in the December 18 meeting. In that meeting people argued for using government power to reverse the election.123 The records do not show one secret network that links Flynn's foreign-agent work to January 6.
What Flynn admitted
In his signed 2017 statement of offense, Flynn admitted he made false statements to the FBI. Those statements were about his talks with Russian Ambassador Sergey Kislyak during the transition.1 He also admitted that foreign-agent filings held false statements and left things out. That work helped the Republic of Turkey.1
That document was part of Flynn's guilty plea. The later pardon shielded that conduct from federal punishment. It did not erase what he had signed.12
What Trump pardoned
On November 25, 2020, Trump gave Flynn a “full and unconditional pardon.” The pardon went past the charged false-statements crime. It also covered conduct in the statement of offense. And it covered possible related crimes under the Special Counsel's authority.2
Flynn signed the statement of offense and pleaded guilty.
Trump issued the pardon.
Flynn joined the surprise White House meeting.
What happened twenty-three days later
The January 6 Committee's final report puts Flynn in the December 18 White House meeting. Sidney Powell and Patrick Byrne were there too.3 The report says they talked about naming Powell as special counsel. They also talked about seizing voting machines. White House lawyers and advisers pushed back.3
Flynn's presence does not prove that he wrote every idea. It does not prove that he led the Capitol attack. It does show something else. Right after his pardon, Flynn went back to the center of the effort. That effort tried to keep the president in power after he lost.
The accountability question
A pardon is a power under the Constitution. When a president pardons an ally, the public has a duty to watch what comes next. Flynn did not step back quietly. He took part in a White House meeting. There, people discussed extreme uses of federal power against an election result.
Flynn's signed admissions. The date and reach of the pardon. His presence at the December 18 meeting. And the ideas the official report says were discussed there.
Not establishedThat the pardon was a clear deal for later action. That Flynn wrote every idea. That one money or command network ties together the foreign-agent case, QAnon, his later political tours, and the January 6 attack.
